Local Law 88: Lighting and Submetering

Upgrade Requirements, Reporting, and Penalties

Article 310: Required Upgrade of Lighting Systems

  • No later than January 1, 2025 the lighting systems of covered buildings shall be in compliance with the standards for new systems

 

Article 311: Installation of Electrical Sub-Meters In Tenant Spaces

  • On and after January 1, 2025, the electrical consumption of each covered tenant space shall be measured by one or more sub-meters
  • Sub-meters shall be installed in existing covered tenant spaces by the owner or lessor by January 1, 2025, and in new covered tenant spaces thereafter.
    • If the covered tenant space is a floor with multiple tenancies, each tenancy of 5,000 sq. ft. or less shall (i) have a separate sub-meter, (ii) share a sub-meter with other spaces, or (iii) share a sub-meter for the entire floor.

 

Upgrades of Lighting Systems:

  • Report for required upgrades of lighting systems
    • No later than May 1, 2025, the owner of a covered building must submit a report
    • The report must include:
      • An attestation confirming the building's lighting system meets the NYC Energy Conservation Code
  • Penalty
    • An owner of a covered building shall be liable for a civil penalty in the amount of $1,500 for failing to file a report

 

Installation of Electrical Sub-meters:

  • Report for required installation of electrical sub-meters
    • No later than May 1, 2025, the owner of a covered building must submit a report
    • Report must include:
      • A list of all covered tenant spaces in such covered building
      • An attestation certifying that sub-meters have been installed for all covered tenant spaces
      • A sample monthly statement
      • Penalty for failure to demonstrate installation
  • Penalty
    • Failing to file a report
      • An owner of a covered building shall be liable for a civil penalty in the amount of $1,500 for
    • Failing to install
      • Classified as a lesser violation
      • An owner of a covered building shall be liable for a civil penalty
      • Such penalty will be in the amount of $500 for each covered tenant space where a sub-meter has not been installed as required
