Article 320: Penalties & Enforcement

  • Emissions Limits:
    • Most commercial: The limit is 25,000 metric tons of CO2 for buildings with a floor area of 50,000 square feet or more.
    1. Residential buildings: There are specific limits based on the building type and size, but they follow a similar structure to commercial buildings.
  • Penalties:
    • If a building exceeds emissions limits, fines are $268 per ton of CO2 over the limit, starting in 2024. The fine increases each year if the building doesn’t comply.
  • Exemptions:
    • Small buildings (<25,000 sq. ft.) and some historic buildings may be exempt.
  • Deadline:
    • The emissions limits start in 2024.

 

Article 321: Reporting Requirements

  • Requirements:
    • Buildings over 25,000 sq. ft. must submit annual reports on energy consumption and emissions data.
  • Reporting:
    • Buildings over 25,000 sq. ft. must report their energy use and emissions data.
  • Deadline:
    • First report is due in 2025 for 2024 data.
  • Penalties for Non-Reporting:
    • $500 fine for failing to submit the required report.
    • An additional $500 for each 30-day period after the deadline that the report is still not submitted.
