Article 320: Penalties & Enforcement
- Emissions Limits:
- Most commercial: The limit is 25,000 metric tons of CO2 for buildings with a floor area of 50,000 square feet or more.
- Residential buildings: There are specific limits based on the building type and size, but they follow a similar structure to commercial buildings.
- Penalties:
- If a building exceeds emissions limits, fines are $268 per ton of CO2 over the limit, starting in 2024. The fine increases each year if the building doesn’t comply.
- Exemptions:
- Small buildings (<25,000 sq. ft.) and some historic buildings may be exempt.
- Deadline:
- The emissions limits start in 2024.
Article 321: Reporting Requirements
- Requirements:
- Buildings over 25,000 sq. ft. must submit annual reports on energy consumption and emissions data.
- Reporting:
- Buildings over 25,000 sq. ft. must report their energy use and emissions data.
- Deadline:
- First report is due in 2025 for 2024 data.
- Penalties for Non-Reporting:
- $500 fine for failing to submit the required report.
- An additional $500 for each 30-day period after the deadline that the report is still not submitted.
